These Terms of Service (“Terms”) govern your use of the AmArte Plus website and any related online services
(collectively, the “Site”). By accessing or using our Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About AmArte Plus

AmArte Plus is a Sacramento, California–based home improvement retailer and remodeling service provider serving Northern California.
We provide products and services including flooring, painting, kitchen remodeling, kitchen cabinets, countertops, and fix & flip renovations.

2. Use of the Site

  • You agree to use the Site only for lawful purposes and in compliance with all applicable federal, state, and local laws.
  • You may not attempt to disrupt, damage, or gain unauthorized access to the Site or any related systems.
  • We may update, suspend, or discontinue any part of the Site at any time without notice.

3. Quotes, Consultations, and Project Requests

  • Submitting a quote request does not guarantee acceptance of a project or a final price.
  • Any estimate provided through the Site is preliminary and may change after an on-site visit, measurements, product selection, or scope confirmation.
  • Project timelines are estimates and may change due to availability, material lead times, permitting, weather, or unforeseen site conditions.

4. Home Improvement Contracts (California Notice)

If you hire AmArte Plus for installation or remodeling work, the project will be governed by a separate written agreement (“Project Contract”)
that complies with California law. For residential home improvement projects over $500, California requires a written home improvement contract
with specific consumer notices and terms. Please review your Project Contract carefully before signing.

5. Product Information and Availability

  • We work to keep product descriptions, pricing, and availability accurate, but errors may occur.
  • Actual product colors, textures, and finishes may vary from images due to lighting, screen settings, or manufacturing differences.
  • We reserve the right to correct errors and update information at any time.

6. Payments and Deposits

  • Payment terms, deposits, and cancellation/refund rules for services are defined in your Project Contract.
  • For product purchases, final pricing and payment terms will be confirmed at checkout or in your invoice.

7. Warranties and Disclaimers

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law,
AmArte Plus disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose,
and non-infringement regarding the Site.

Product warranties (if any) are provided by the manufacturer or may be specified in your Project Contract.

8. Limitation of Liability

To the fullest extent permitted by law, AmArte Plus will not be liable for any indirect, incidental, special, consequential,
or punitive damages arising from your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.

Our total liability for any claim related to the Site will not exceed the amount you paid to AmArte Plus through the Site in the 12 months
before the claim, if any.

9. Intellectual Property

All content on the Site (text, images, logos, designs, graphics, and layout) is owned by AmArte Plus or licensed to us and is protected by
intellectual property laws. You may not copy, reproduce, modify, or distribute Site content without written permission.

10. User Submissions

  • If you submit reviews, project details, photos, or other content, you grant AmArte Plus a non-exclusive, royalty-free license to use it
    for business purposes such as providing services, customer support, marketing, or showcasing projects.
  • You confirm that you have the right to submit the content and that it does not violate any third-party rights.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use information.

12. Third-Party Links and Services

The Site may contain links to third-party websites or tools (such as social media platforms or payment/analytics providers).
AmArte Plus is not responsible for third-party content, policies, or practices.
